Iain has developed a significant property law practice since joining Fenners Chambers with a particular focus on landlord and tenant disputes. Iain frequently appears in court on interlocutory applications through to multi-track trials. He has appeared in both the High Court and the Court of Appeal. Iain has a significant paperwork practice settling pleadings and advising on all aspects of liability and quantum.
Areas of practice
- Possession proceedings: social and private landlords, mortgage and rent arrears, breach of tenancy, anti-social behaviour, Article 8 ECHR claims
- Residential landlord and tenant: disrepair, forfeiture, service charges, tenancy deposits and unlawful eviction
- Commercial landlord and tenant: dilapidations, tenancy renewal, forfeiture, service charges and unlawful eviction
- Property law: ownership of property (trusts of land), trespass and boundary disputes.
Iain accepts instructions from members of the public and fellow professionals as well as traditional referrals from solicitors.
Successfully defended an appeal against a possession order made in favour of Lloyds TSB.
